This Program Agreement ("Agreement") is entered into by and between KastKing ("Merchant") and the affiliate participant ("Affiliate") for the purpose of establishing the terms and conditions under which the Affiliate will promote the Merchant's products or services through the ShareASale affiliate marketing platform ("Program").

1. Enrollment:
1.1. Affiliate agrees to apply to join the Merchant's affiliate program through ShareASale and provide accurate and complete information during the application process.
1.2. Merchant reserves the right to accept or reject any application at its sole discretion.
1.3. Upon acceptance into the program, Affiliate will be provided with unique affiliate links, banners, and other promotional materials for marketing purposes.

2. Affiliate Obligations:
2.1. Affiliate agrees to promote the Merchant's products or services in a professional and ethical manner.
2.2. Affiliate will ensure that all marketing activities comply with applicable laws, regulations, and industry standards.
2.3. Affiliate will not engage in any fraudulent, misleading, or deceptive practices, including but not limited to spamming, cookie stuffing, or unauthorized use of trademarks or copyrighted materials.

3. Commission and Payment:
3.1. Affiliate will earn a commission on qualified sales generated through their affiliate links.
3.2. The commission rate and payment terms will be specified by the Merchant in ShareASale's interface or as communicated separately.
3.3. The commission will not be given for any code, offer, or promotion that is not available and listed as active on ShareASale and kastking.com. Merchant reserves the right to reconcile or adjust the value of any transaction that is attributed to another marketing channel.
3.4. Merchant will track sales and calculate commissions based on its own system. Any discrepancies should be reported to Merchant within 30 days.
3.5. Payments will be made according to the payment schedule set by the Merchant, usually on a monthly basis. Minimum payout thresholds may apply.

4. Termination:
4.1. Either party may terminate this Agreement at any time for any reason by providing written notice to the other party.
4.2. Upon termination, Affiliate will immediately cease promoting the Merchant's products or services and remove all affiliate links and promotional materials.

5. Limitation of Liability:
5.1. Merchant shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with this Agreement or the Program.
5.2. Affiliate agrees to indemnify and hold Merchant harmless from any claims, damages, or liabilities arising out of Affiliate's participation in the Program.

6. Governing Law and Jurisdiction:
6.1. This Agreement shall be governed by and construed in accordance with the laws of New York.
6.2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in New York.

By participating in the Merchant's affiliate program, Affiliate acknowledges and agrees to be bound by the terms and conditions of this Agreement.
